biolitec wins patent infringement case against AMS in US district court – European Urology Association meeting in Stockholm shows strong interest in biolitec's Benign Prostate Hyperplasia treatment device

Jena, March 23rd, 2009 - biolitec AG, Jena, listed in the Prime Standard of the Frankfurt stock exchange (ISIN DE0005213409) scored a mayor victory in the United States District Court for the District of Massachusetts against American Medical Systems (AMS). The court found the biolitec LIFE (Laser Induced Flow Enhancement) method and Evolve (diode) laser not to infringe. The essential feature of biolitec’s product and method is its absorption in water, the court stated. While the 532 nm green light radiation of AMS is transmitted through water, biolitec features water absorption - this is considered by biolitec as key safety characteristics, precluding any accidental bladder damage. The EUA (European Urology Association) meeting showed the high interest in biolitec's method and the new Twister fiber introduced at this show in particular.

While there is one more lawsuit with AMS pending on the classical Sidefiber (which biolitec considers to be without merit) the new fiber version has enhanced features enabling even enucleating and is significantly more durable as well as avoiding the claimed infringement issue (alleged in the second lawsuit) altogether. The USA market is the main market for laser BPH procedures worldwide and therefore a mayor progress for biolitec's market position has been achieved.
